"Seizures On Whim...": Press Bodies To Chief Justice After NewsClick Raids
A day after the Delhi Police action against the NewsClick portal, several prominent press organisations have written to Chief Justice Of India DY Chandrachud, seeking evolved guidelines for the interrogation of journalists and for seizures from them.
"India's freedoms will be safe as long as journalists can speak truth to power, without being chilled by a threat of reprisal," the press bodies said.
The press bodies cited the instance of raids conducted on October 3 on the homes of 46 employees of NewsClick.
The letter alleged that the country's "investigating agencies have been misused and weaponised against the press".
Frame norms "to discourage the seizure of journalists' phones and laptops on a whim, as has been the case", read the letter which also demanded to ensure that investigations are not undertaken as "fishing expeditions with no bearing to actual offences and finding ways to ensure the accountability of state agencies".
"As journalists and news professionals, we are always ready and willing to cooperate with any bona fide investigation. However, ad hoc, sweeping seizures and interrogations surely cannot be considered acceptable in any democratic country, let alone one that has begun advertising itself as the 'mother of democracy," it said.
The letter has been signed by 15 organisations, including the Digipub News India Foundation, Indian Women's Press Corps, and the Press Club of India.
The letter also flagged that a large section of journalists in India are "working under the threat of reprisal".
It demanded the judiciary to "confront power with a fundamental truth - that there is a Constitution to which we are all answerable".
"Subjecting journalists to a concentrated criminal process because the government disapproves of their coverage of national and international affairs is an attempt to chill the press by the threat of reprisal-the very ingredient you identified as a threat to freedom," the letter read.
"We do not say that journalists are above the law. We are not and do not wish to be. However, intimidation of the media affects the democratic fabric of society," it said.
NewsClick founder Prabir Purkayastha and human resources head Amit Chakravarty, arrested in a case filed under anti-terror law UAPA, have been sent to police custody for seven days.
Citing the case of Siddique Kappan - who was in jail for more than two years before securing bail - the letter demanded "a wide immunity against coercion must be read into the constitutional provisions of free speech, and methods must be devised against police overreach - especially given the repeated misuse of these powers".
"Far too much is at stake to test every case at the end of a trial which can last years. Journalists arrested under UAPA can end up spending months if not years," it said.
The ruling Bharatiya Janata Party (BJP) has justified the police action against NewsClick, saying those involved in anti-India activities will face the strictest action as people have given the mandate to the Narendra Modi government to deal firmly with such elements.
Police have sealed NewsClick's office in Delhi. Forty-six suspects were questioned and digital devices, including laptops and mobile phones, besides documents taken away for examination.

Ricky Kej Blames Trevor Noah For Bengaluru Show's Failure: ''If He...''
Three-time Grammy award-winning musician Ricky Kej on Wednesday slammed Trevor Noah in a lengthy social media post after the comedian posted a farewell note to sum up his 'Off The Record' India tour. Notably, the comedian's tour became a point of chatter and debate after both his shows in Bengaluru were junked due to audio issues at the venue. The comedian, in his post, promised to return to the city.
Mr. Kej, however, was not convinced by his note and partly blamed him for the show's failure. He noted that every ''responsible and caring artist'' does a thorough ''soundcheck" and ''venue recce'' before a show. Though the musician acknowledged event management-related problems, he said he was shocked that Mr. Noah did not personally conduct a ''reconnaissance'' of the venue, or communicate the technical requirements and specifications to event organizers.
''If Trevor Noah really bothered about his ticket-purchasing fans, then he would have made it a point to arrive earlier in the day (or the previous night) and personally carried out a reconnaissance of the venue, tested out his microphone and ensured that the sound was optimum. I am sure he does that at other prestigious venues all over the world, and I am shocked to realize he did not bother to do this in Bengaluru. This is the artist's responsibility. Every artist/comedian/band has personal sound requirements and preferences.. and to just show up for the event, without even checking your sound is hugely irresponsible,'' he wrote.

Not stopping there, the musician mentioned other international artists who have had ''super successful events'' in Bengaluru because they ''worked with everyone involved to deliver a spectacular concert.''
''When Deep Purple, Pink Floyd, Beyonce, Black Eyed Peas, Iron Maiden, Bryan Adams, Metallica, Symphony Orchestras, Russel Peters, etc. have had super successful events in Bengaluru, why is Bengaluru being trashed now?'', he wrote.
''Trevor also attributed this incident to "India" as a whole, which is in very bad taste. This is definitely a case of terrible event management, but more importantly a very complacent and irresponsible artist with a complete disregard for his paying fans (and India).. who blames everyone and everything but himself,'' he concluded his long post.
Mr Noah was to perform at the Manpho Convention Centre in Bengaluru last week as part of his 'Off the Record' tour. The organisers canceled both shows as there were audio issues at the venue. However, Mr. Noah apologised to his fans who came all the way to watch it and promised a full refund.
He performed at the Jawaharlal Nehru Indoor Stadium, Delhi-NCR on September 22, 23, and 24, and in Mumbai on September 30.

"China-Linked Entities Gave NewsClick Rs 38 Crore": Police Sources
The Delhi Police has levelled a series of strong allegations against NewsClick, whose founder and HR head have been arrested under a stringent anti-terror law. Sources in the force alleged the news portal received Rs 38 crore from entities linked to Chinese individuals and some of its funds were shared with activists Gautam Navlakha and Teesta Setalvad, who are accused in other cases.
Days after a New York Times investigation alleged that the news portal had received money for pro-China propaganda, the police carried out searches at the home of journalists linked to NewsClick at over 100 locations in Delhi-NCR and Mumbai on Tuesday.
Inflow
Delhi Police sources alleged NewsClick received Rs 38 crore from entities allegedly linked to Chinese individuals and the funds were used to influence pro-China content on the portal. They claimed Rs 9 crore was received as Foreign Direct Investment (FDI) through inflating share prices and 29 crore was received as fees for export services.
"No proof was submitted by NewsClick for exporting any services to foreign entities," a source said.
'Fund Sharing?'
The sources claimed that some of the funds collected by NewsClick were also shared with Gautam Navlakha and Teesta Setalavad.
Mr Navlakha was arrested in the Elgar Parishad-Maoist links case in 2018 and has been under arrest since then. In November last year, the Supreme Court had allowed the journalist-activist to be placed under house arrest because of his deteriorating health condition.
Mr Navlakha was among several activists who had been arrested in a case related to alleged inflammatory speeches made at the Elgar Parishad conclave held on December 31, 2017. Police claimed that these speeches triggered violence the next day at a gathering near the Koregaon-Bhima war memorial near the city.
Teesta Setalavad was arrested in June 2022 along with former Gujarat police chief RB Sreekumar and former IPS officer Sanjiv Bhatt for allegedly using her close associates and riot victims to file "false and fabricated affidavits before the Supreme Court with a view to unseat the establishment and to tarnish the image of the establishment and the then chief minister."
She was granted bail by the Supreme Court in July this year. The bench had questioned the motives and timing of Ms Setalvad's arrest and said it thought the case against her was suspect.
NewsClick has not reacted to these charges so far.
Other Reactions
The sources said 46 individuals associated with NewsClick are under investigation by agencies. "A total of 37 male suspects have been questioned at premises, 9 female suspects have been questioned at their respective places of stay and digital devices, documents etc. have been seized/collected for examination. The proceedings are still ongoing; so far, two accused have been arrested - NewsClick founder Prabir Purkayastha and HR head Amit Chakravarty," a source said.
A statement released by the Editors Guild of India said, "EGI is concerned that these raids are yet another attempt to muzzle the media. While we recognise that the law must take its course if actual offences are involved, the due process has to be followed. The investigation of specific offences must not create a general atmosphere of intimidation under the shadow of draconian laws, or impinge on the freedom of expression and the raising of dissenting and critical voices."
The Opposition parties have slammed the government over the raids. "The Indian National Developmental Inclusive Alliance (INDIA) parties strongly condemn the Bharatiya Janata Party (BJP) government's fresh attack on the media. We steadfastly stand with the media and for the constitutionally protected freedoms of speech and expression," a joint statement by the bloc said.
The government has, however, said it does not need to justify the agencies' action. "If anyone has done anything wrong, search agencies are free to carry out investigations against them under set guidelines," Union Minister Anurag Thakur said.

"When I Was Net Bowler For Indian Team...": Rauf On Early Duels With Kohli
Whenever the names of Virat Kohli and Haris Rauf are taken in the same sentence, fans get the flashbacks of the 2022 T20 World Cup. Kohli's twin sixes to Rauf in the penultimate over the match helped India win a historic contest that saw Kohli perform at his absolute best. Rauf also spoke about his admiration for South African pace legend Dale Steyn.
"I used to watch Dale Steyn and I liked the way he used to show aggression on the field after picking up a wicket. He inspired me to be aggressive on the field. That's why he is my idol," Rauf further said.
